42Fab & Weld It Yourself Kits Licensing

The designs and associated files for all Weld It Yourself Kits are the copyrighted intellectual property of 42Fab LLC. As the requests for our design files have increased, we have decided to make those files available to the public under one of the three license formats below. Please read and select the appropriate license for your needs. Your license dictates your rights and responsibilities when using the property of 42Fab LLC.

Personal or Single Commercial Use License

42Fab LLC grants you a non-exclusive, non-transferrable, license to produce as many units of the licensed product for your own use or to give as gifts.
You may also produce a single unit for sale per license purchased.
You may not gift, sell, or otherwise distribute the parts that make up the licensed product in an unassembled or kit format, with the exception of products produced by you AND assembled with the gift recipient.
You grant 42Fab LLC and associated entities the right to feature (with attribution) any images or video (media) of the finished product on this and associated websites and/or social media, and assign a transferable, non-revocable, perpetual, global license to the copyright of such media to 42Fab LLC.
You may not share, sell, give away, or in any other way distribute the licensed files or any derivation thereof.
You will indemnify, defend, and hold harmless 42Fab LLC and related entities for any losses or damages arising from the production, sale, gifting, or use of the completed projects and will cooperate with any investigation of breeches of this license and will reimburse 42Fab LLC for all costs associated with defending the intellectual property licensed should a breech occur. You agree the damages from unlicensed release of the licensed property shall be the value of the greatest license fee ever collected multiplied by the number of unauthorized downloads or shares of the licensed material.

Small Business License

IF your business, whether incorporated or of hobby status, generates less than $100,000 USD in gross income per year, you may purchase this license and use it with the same rights, restrictions, and responsibilities of the Limited Commercial Use License below while your business gross income remains below $100,000 USD per year. You may contact 42Fab LLC directly for a discounted license upgrade to a full commercial license.

Limited Commercial Use License

For one year from the date of your license purchase, 42Fab LLC grants you a non-exclusive, non-transferrable, license to produce up to 100 units of the licensed product for your own use, to give as gifts, or to sell as a completed product. Upon producing 100 products from this licensed file, you license is deemed expired and must be repurchased to continue production.
Should 42Fab LLC or associated entities continue to sell licenses for the licensed product at the expiration of your license term, your license is deemed extended for as long as the license is still offered for sale (In short, this license is perpetual for as long as we continue to sell licenses. If we decide to discontinue licensing the specific product your purchased a license for, your license will expire upon notification via the email used when ordering your license, but such expiration shall not happen within one year of your purchase.)
You may not gift, sell, or otherwise distribute the parts that make up the licensed product in an unassembled or kit format, with the exception of products produced by you AND assembled with the gift recipient.

Educational Use License

Your organization must either be a certified educational institution (if your organization has a .edu domain extension you qualify) or you must receive approval via email from 42Fab LLC (makerspaces and private welding schools will generally qualify) to utilize the Educational Use License.
42Fab LLC grants you a non-exclusive, non-transferrable, license to produce as the license product for a minimum of one academic year or with 50 students, whichever comes later. Upon exhaustion of your license, a new license must be purchased to continue using the licensed files.
You may not gift, sell, or otherwise distribute the parts that make up the licensed product in an unassembled or kit format, with the exception of products produced by you AND assembled with or by a student at your educational institution.
You may not sell the completed products except where the proceeds of such sales are remitted to the student or are directly returned to the educational institution to support current or future students.
You grant 42Fab LLC and associated entities the right to feature (with attribution) any images or video (media) of the finished product on this and associated websites and/or social media, and assign a transferable, non-revocable, perpetual, global license to the copyright of such media to 42Fab LLC.
You may not share, sell, give away, or in any other way distribute the licensed files or any derivation thereof.
